Terms of Use for the NearbYYou App
These terms govern the permitted use of the NearbYYou app, the limits of that use and the handling of misuse or safety violations.
Scope
These terms of use apply to the use of the NearbYYou app and the associated backend services.
Description of Services
The app enables, in particular, login by email verification, creation of a profile, upload of a profile photo, transmission of location data for matching, receipt of matches and the use of a chat function for unlocked matches.
Using the app requires responsible, lawful and respectful interaction with other users.
Registration and Access
Use of the app requires a correct and current email address. Users are obliged to protect their access credentials and devices against unauthorised access.
Minimum Age
The app may only be used by persons who are at least 18 years old.
Permitted Use
The app may only be used in compliance with applicable law and these terms of use. In particular, fake profiles, the use of third-party photos without permission, harassment, threats, intimidation, discriminatory content, grooming, fraud attempts, abusive API use and the circumvention of security mechanisms are prohibited.
User Content
Users are solely responsible for the content they upload or share. They may only upload or send content for which they hold the necessary rights and which does not infringe third-party rights.
No Guarantee of Contacts or Identities
We do not guarantee that matches will actually occur, that user information is complete or true, that profile photos are current or authentic, or that any particular compatibility, safety or suitability for meetings exists. Use of the app and any contact made through it is at your own responsibility.
Safety in Meetings and Communication
The app does not replace your own caution. Users should in particular not assume identities are genuine without verification, should not disclose unnecessary sensitive information too early, should not accept money requests and should only arrange first meetings in safe public places.
Moderation, Restriction and Removal
We reserve the right to remove content and to temporarily or permanently restrict or suspend accounts where there are indications of violations, misuse, risks or legal infringements.
Availability
There is no entitlement to uninterrupted or permanent availability of the app. Maintenance, security measures, disruptions or further development may temporarily restrict use.
Liability
To the extent permitted by law, we are not liable for the behaviour of other users, the accuracy of third-party profile information, unsuccessful contacts or meetings, damage arising from interactions taking place outside the app or data loss and outages, unless mandatory statutory liability applies. Liability for intent, gross negligence and all other cases in which limitation of liability is not permitted by law remains unaffected.

Termination and Deletion
Accounts may be terminated and deleted in accordance with the deletion and retention rules described in the privacy policy.
Changes
We reserve the right to amend these terms of use for the future if this is objectively necessary and users are appropriately informed.
